Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Museum Air website, mobile application, and related services (collectively, the "Services"), which are developed and operated by Intera LLC ("Intera," "Museum Air," "we," "our," or "us").

By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Use of the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for personal, lawful purposes.

You agree not to:

Your first profile photo must be a recent, clear photograph of your own face, unobstructed and well lit. It is used by the person you are meeting to recognize you at the meeting point and by Museum Air to confirm who attended a meetup. If you do not provide one, or it no longer resembles you, your account is subject to review and may be terminated under Section 7.

3. Meetups, Cancellations and No-Shows

Meetups take place at the museum's front entrance at the time both participants confirmed. Check-in runs on your phone: bring it charged and connected to the internet, with location and camera access allowed. Museum Air cannot confirm a meetup from a phone that is off, offline or without those permissions, and a technical problem on your device does not establish that you attended.

You may cancel or propose a new time free of charge until 24 hours before the meetup. Within 24 hours, a cancellation costs $30 for each person in the other party who is left waiting, capped at $60. Not showing up, or arriving and refusing to complete the meetup, costs $45 for each person left waiting, capped at $90. No one is charged until one participant's presence at the entrance has been established through the app's check-in and selfie check; a participant who claims to be present and cannot show it when asked is treated as a no-show. For example, a host who does not appear for John, Jake and Tom owes $90.

Fees are charged to the payment method on file five days after the meetup, after review, and are paid to the museum of that meetup less a 20% handling fee retained by Museum Air. Repeated late cancellations or no-shows may limit or suspend your ability to send or accept invitations.

4. Intellectual Property

The Services, including all software, design, branding, content, and related materials, are owned by or licensed to Intera LLC and are protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, display, publish, or use our branding, content, or materials without our prior written permission, except as otherwise permitted by law.

5. Privacy

Your use of the Services is also subject to our Privacy Policy.

6. Support and Communications

We provide functional support for users of the Services. For technical assistance, bug reporting, or general inquiries, users may contact us using the information provided in the Contact Us section below.

7. Suspension or Termination

We may suspend or terminate access to the Services at any time if we believe you have violated these Terms, created risk for the Services or other users, or used the Services in an unlawful or harmful manner. This includes accounts without the profile photo required under Section 2.

8. Disclaimers and Limitation of Liability

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Intera LLC disclaims all warranties, express or implied.

To the fullest extent permitted by law, Intera LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after updated Terms are posted constitutes your acceptance of the revised Terms.
